These Terms of Service (“Terms”) govern your access to and use of VFX OASIS, operated by Jacob Zirkle (“we,” “us,” or “our”). By accessing or using our website, products, or services, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our services.

1. Overview of Services

VFX Oasis provides digital visual effects (VFX) assets, including but not limited to animations, motion capture data, models, textures, and related digital content (“Assets”). Assets are delivered digitally and made available through subscription plans.

All content is delivered electronically. No physical products are shipped.

2. Eligibility

You must be at least 16 years old to use this site or have permission from a legal guardian. By using the site, you confirm that you meet this requirement.

3. Accounts

To access certain features, including downloads and subscriptions, you may be required to create an account.

You are responsible for:

  • Maintaining the confidentiality of your account credentials

  • All activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions & Access

If you purchase a subscription:

  • Access to Assets is provided only while your subscription is active

  • Available Assets depend on the specific plan you select

  • Subscription benefits end immediately upon cancellation or expiration

  • Each account represents a single-user seat with a single subscription.

We reserve the right to modify, add, or remove Assets from the subscription library at any time.

5. Digital Downloads

Assets can be downloaded directly from their individual product pages when access is available.

Due to the digital nature of the content:

  • All downloads are delivered instantly

  • Access may be revoked if your subscription ends or your account is terminated

  • We do not guarantee permanent access to subscription-based content after cancellation

6. License & Usage Rights

When you download an Asset, you are granted a non-exclusive, non-transferable license to use the Asset in accordance with the license terms.

Unless otherwise stated:

  • Assets may be used in commercial and personal projects

  • Assets may not be redistributed, resold, shared, sublicensed, or made available as standalone files

  • Assets may not be uploaded to asset marketplaces, repositories, or shared libraries

Ownership of all Assets remains with Jacob Zirkle or its licensors.

7. Prohibited Uses

You agree not to:

  • Share your account or Assets with others

  • Circumvent access controls or security features

  • Redistribute or resell Assets in any form

  • Use Assets in a way that violates applicable laws or third-party rights

Violation of these terms may result in immediate account termination without refund.

8. Refund Policy

Due to the digital nature of our products and instant access to content, all sales are final.

Refunds are only considered in cases of verified account-related or billing errors, such as:

  • Duplicate charges

  • Technical issues preventing access to purchased content

Refunds are not provided for reasons such as:

  • No longer needing the Assets

  • Project changes

  • Accidental purchases

  • Failure to cancel a subscription on time

Reach out to us for refund requests and we will address on a case-by-case basis. We receive the right to deny refunds at our discretion.

9. Termination

We reserve the right to suspend or terminate access to the site or services at our discretion, including for violations of these Terms.

Upon termination:

  • Access to Assets may be revoked

  • Licenses granted may be terminated

  • No refunds will be issued unless required by law

10. Intellectual Property

All content on this site, including Assets, branding, text, graphics, and code, is the intellectual property of Jacob Zirkle and is protected by copyright and other applicable laws.

11. Disclaimer of Warranties

All services and Assets are provided “as is” and “as available.”

We make no warranties regarding:

  • Fitness for a particular purpose

  • Compatibility with specific software or pipelines

  • Error-free or uninterrupted access

Use of the Assets is at your own risk.

12. Limitation of Liability

To the fullest extent permitted by law, Jacob Zirkle shall not be liable for any indirect, incidental, or consequential damages arising from your use of the site or Assets.

Our total liability shall not exceed the amount paid by you in the 3 months preceding the claim.

13. International Users

Our services are available worldwide. By using the site, you acknowledge that you are responsible for complying with local laws and regulations applicable in your jurisdiction.

14. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to the website. Continued use of the site constitutes acceptance of the updated Terms.
